Failure to Appear

If you fail to appear for any reason on any charge, a warrant will be issued for your arrest. If the failure to appear is on a traffic violation, your driving privilege will be suspended. Once a warrant is issued, a court appearance may become mandatory. You can choose to be arrested on this warrant and bond to receive a new court date, you can apply for the Warrant Recall Act, if eligible, or your offense may be payable. Please contact the Court office for your options. Any license suspensions will remain in effect until the resolution of the case.

Warrant Recall Act 2013-293

This act allows a defendant to request that his/her warrant for failure to appear or failure to pay be recalled. Should this request be granted, the defendant will pay $100.00 per case, in cash, before the warrant will be recalled. Any license suspensions will remain in effect until the resolution of the case. Requests can be made in person, BY THE DEFENDANT, Monday-Friday during business hours.  

Payable Failure To Appear--Traffic Citations

Effective October 1, 2018, certain traffic citations that have a failure to appear status or an active warrant for failure to appear will now be payable without a court appearance.

If the traffic citation is listed on the schedule of fines prior to becoming a failure to appear, you may now pay the citation and associated fees. Please call 256-233-8733 to see if your case is eligible.
